1. About Homify Tech Malaysia
Homify Tech Malaysia (“we,” “our,” or “us”) is a solar photovoltaic (PV) system provider and home technology solutions company operating in Malaysia. We offer residential and commercial solar installation services, energy consultation, system assessments, and related after-sales support.
Our registered business operates under Malaysian law. All services are subject to these Terms & Conditions and any additional agreements entered into between us and the client.
2. Use of This Website
By visiting and using homifytech.com.my, you agree to the following conditions of use:
- You must be at least 18 years of age to submit enquiries or enter into any service agreement with us.
- You agree not to misuse, disrupt, or attempt to gain unauthorised access to our website or its related systems.
- All content on this website — including text, images, graphics, and data — is the intellectual property of Homify Tech Malaysia and may not be reproduced without written permission.
- We reserve the right to modify or discontinue any part of the website without prior notice.
3. Enquiries, Quotes, and Consultations
When you submit an enquiry form, request a quote, or schedule a consultation through our website or advertisements:
- You consent to being contacted by our team via phone, email, or messaging platforms (such as WhatsApp) to follow up on your enquiry.
- Any quotation or proposal provided by us is an estimate based on the information supplied and is not a binding contract until a formal agreement is signed by both parties.
- Quoted prices are subject to change based on site assessment findings, material costs, and applicable government incentive programmes (e.g., SEDA SELCO or MESTECC schemes) at the time of agreement.
- We reserve the right to decline any project at our sole discretion.
4. Solar PV System Services
Our solar installation and related services are governed by the following terms:
- Site Assessment: A physical or virtual site assessment will be conducted prior to confirming any installation quotation. Final pricing may vary from initial estimates following assessment.
- Installation Timeline: Estimated installation timelines are provided in good faith. Delays may occur due to weather conditions, supply chain issues, TNB grid connection processing, or other factors beyond our control. We will communicate any significant delays promptly.
- Third-Party Approvals: Grid-tied solar systems require approval from Tenaga Nasional Berhad (TNB) and, where applicable, the Sustainable Energy Development Authority (SEDA). We will assist with the application process, but approval timelines are determined by the respective authorities and are outside our control.
- Client Responsibilities: Clients must ensure that premises, electrical infrastructure, and roof structures are suitable for installation. Any pre-existing issues discovered during installation that require rectification may incur additional costs.
5. Pricing, Payment, and Invoicing
All pricing is stated in Malaysian Ringgit (MYR) and is inclusive of applicable taxes unless otherwise stated.
- A deposit is required upon signing the service agreement. The exact percentage will be stated in the formal quotation.
- Remaining progress payments are due at milestones specified in the project agreement (e.g., upon equipment delivery, upon installation completion).
- Final payment is due upon system commissioning or handover, whichever is earlier.
- Late payments may result in suspension of services and may incur late payment charges as stated in the service agreement.
- All invoices must be settled within the payment terms specified. We accept bank transfer, online banking (FPX), and other methods as agreed.
6. Warranties and Guarantees
Homify Tech Malaysia provides the following standard warranties, subject to terms in the individual project agreement:
- Workmanship Warranty: We warrant our installation workmanship against defects for a period as stated in your project agreement from the date of commissioning.
- Equipment Warranty: Solar panels, inverters, and other major components are covered by their respective manufacturers’ warranties. We will assist in facilitating warranty claims on your behalf.
- Warranties are void if damage results from unauthorised modifications, tampering, misuse, natural disasters, or failure to follow maintenance guidelines.
- Warranty claims must be submitted in writing to our support team within the warranty period.
7. Limitation of Liability
To the fullest extent permitted by Malaysian law:
- We shall not be liable for any indirect, incidental, or consequential losses arising from the use of our services or website, including loss of energy savings projections, loss of income, or data loss.
- Energy savings estimates and payback period projections provided by us are indicative only and are based on assumptions including current tariff rates, average sunlight hours, and usage patterns. Actual results may vary.
- Our total aggregate liability for any claim shall not exceed the total amount paid by the client for the specific service in dispute.
8. Cancellation and Refund Policy
- Cancellations made before signing the formal service agreement incur no charges.
- Cancellations made after signing but before installation commences may result in forfeiture of the deposit, as deposits cover administrative, design, and procurement costs already incurred.
- Cancellations after installation has commenced will be subject to costs incurred to date, and refunds (if any) will be calculated accordingly.
- Refund requests must be submitted in writing to support@homifytech.com.my and will be reviewed within 14 business days.
9. Intellectual Property
All content published on homifytech.com.my — including logos, text, images, graphics, system designs, and energy calculation tools — is the exclusive intellectual property of Homify Tech Malaysia. You may not copy, distribute, modify, or use any content for commercial purposes without our prior written consent.
10. Third-Party Links and Services
Our website may contain links to third-party websites, tools, or resources (including government portals such as SEDA and TNB). These links are provided for informational convenience only. We do not endorse and accept no responsibility for the content, accuracy, or practices of any third-party websites.
11. Privacy and Data Protection
Your personal data is collected and processed in accordance with our Privacy Policy and in compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. By using our services, you consent to the data practices described therein.
12. Governing Law and Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or our services shall first be referred to mediation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
